These terms and conditions govern the application process, selection criteria, and award of Scholarships offered by Ambassadors Scholarship Foundation ("ASF").



  1. How to Apply. Information on how to apply for and the award of Scholarships form part of these terms and conditions ("Terms"). By submitting an application, each applicant agrees to the Terms and warrants that his or her application complies with all requirements set out in the Terms.


    To apply for a Scholarship visit www.AmbassadorsGiving.org (the "Site") and select one of the Scholarship(s) offered by ASF, then complete an application form with the required information, including your name, address, telephone number, email address, date of birth, and your essay. All applicants must have a valid email address.


  2. Essay Entry Criteria: Essays must be in digital format and must meet all criteria as defined by the particular Scholarship applied for on the Site.


    No literary form other than an essay will be accepted. Essay must reflect the applicant’s own research, writing and original thinking. Only one (1) essay may be submitted by each applicant per Scholarship applied for. Only online applications will be eligible. No offline print or written essay submissions will be accepted. The essay, in its entirety, must be a single work of original material written by the applicant and may not previously have won a scholarship or an award in any other contest, promotion or scholarship offered by ASF or its affiliates.


    By applying for a Scholarship, the applicant entrant represents and warrants that the submitted essay is an original work created solely by the applicant, that the essay does not infringe on the copyrights, trademarks, moral rights, rights of privacy/publicity or intellectual property rights of any person or entity, and that no other party has any right, title, claim, or interest in the essay. Essay submissions must not, in the sole and absolute discretion of ASF, contain obscene, provocative, defamatory, sexually explicit, or otherwise objectionable or inappropriate content and are unacceptable and will render the essay ineligible for a prize.


    The submissions will be judged separately, in accordance with ASF’s judging criteria, as defined below. ASF reserves the right to review all submissions, documents and source material in order to confirm compliance with these Terms. No automated entry devices and/or programs permitted. All submissions become the sole and exclusive property of ASF and receipt of submissions will not be acknowledged or returned.


  3. Application Period. The Scholarship application period begins on the date and time and ends on the date and time as provided for in the specific Scholarship applied for.


  4. Eligibility. Applications for Scholarships offered by ASF are open only to legal residents of the fifty (50) United States, the District of Columbia and Puerto Rico. Submissions originating from any other jurisdiction are not eligible.


    Void where prohibited, taxed or restricted by law. Employees, officers and directors of ASF, Ambassador Programs, Inc., d/b/a People to People Ambassador Programs, and each of their respective subsidiaries, affiliates, partners, advertising and promotion agencies, manufacturers or distributors of Scholarship materials and their immediate families (parents, children, siblings, spouse) or members of the same household (whether related or not) of such employees, officers, and directors are not eligible to enter or win the Scholarship. All federal, state and local laws and regulations apply.


  5. Judging Criteria. Scholarship recipients will be selected by a panel of judges selected by ASF. Each application will be judged based on the following criteria, with equal weight being given to each: relevance of submission to topic, artistic composition, comprehension, organization, creativity, writing style and grammar. Applicant's community involvement, scholastic achievement and financial need will also be taken into consideration. In the event of a tie, the tied submissions will be re-submitted to the judges for a re-judging between the tied submissions alone. In the event that a tie remains after re-judging, the submission with the highest score in the creativity criteria will be declared the Scholarship recipient. Scholarship recipients will be chosen on the date indicated for the specific Scholarship applied for, and notified by email or phone. Decisions of the judges are final and binding in all matters relating to Scholarship awards.


  6. Scholarship(s). The scholarship is a tuition credit only valid towards payment of the cost to participate in (the "Scholarship"). The Scholarship approximate retain value ("ARV") is specific to the Scholarship applied for. Actual retail value may be higher or lower and will depend upon the travel program selected by winner, exact itinerary, airfare fluctuations and city of departure, among other factors. Any difference between the actual retail value and the Scholarship ARV will not be awarded. Should Scholarship recipient select a travel program that the program tuition price exceeds the Scholarship ARV, the Scholarship recipient shall be responsible for any difference. If Scholarship recipient cannot travel or participate on a People to People Student Ambassador Program trip scheduled for summer 2014, the Scholarship will be forfeited and may be awarded to an alternate. Scholarship recipients must also enroll in a program and pass the interview process in order to receive the Scholarship, otherwise the Scholarship will be forfeited and may be awarded to an alternate. Each minor winner must obtain written permission from his/her parent / legal guardian if he/she is a minor in order to receive the Scholarship and to participate in the 2014 People to People Student Ambassador Program trip selected by recipient.


    Scholarship cannot be transferred, assigned, substituted or redeemed for cash except at ASF’s sole discretion The Scholarship may not be combined with any other offer, discount or promotion. Unless expressly stated, the Scholarship does not include travel interruption/cancelation insurance, transfer fees, reinstatements fees, transfers to other offered programs, pre or post program extensions, upgrades, administrative fees, zone fares, or merchandise offered by Ambassador Programs, Inc., d/b/a People to People Ambassador Programs ("API").  All travel is arranged and delivered by API. Entrants seeking Scholarships are subject to API’s standard administrative charges upon withdrawal from the travel program.


    ASF reserves the right, in its sole discretion, to disqualify the Scholarship recipient who fails to meet ASF's eligibility criteria, complete, sign and return the Affidavit of Eligibility and Liability/Publicity Release, or who fails to comply with these Terms. Scholarship recipient must also meet and comply with all API terms and conditions including, without limitation, any application, enrollment process, Booking Conditions and Terms and Conditions of Travel and such other documents reasonable requested by API. In the event of disqualification for any reason, an alternative recipient may be chosen in ASF’s sole discretion.


  7. Notification. Scholarship recipient will be notified by email or phone on the selection date given for the specified Scholarship and will be required to sign and return an Affidavit of Eligibility and Liability/Publicity Release within seven (7) calendar days of Scholarship notification. If Scholarship recipient cannot be contacted within seven (7) calendar days of first notification attempt, fails to return the Affidavit of Eligibility and Liability/Publicity Release as specified above, if Scholarship or Scholarship notification is returned as undeliverable, if recipient rejects his/her Scholarship or in the event of noncompliance with these Terms, such Scholarship will be forfeited and an alternate recipient may be selected from all remaining eligible applications. Upon Scholarship forfeiture, no compensation will be given. Once recipient has signed and returned the Affidavit of Eligibility and Liability/Publicity Release and his/her eligibility has been confirmed, recipient will receive a mailed certificate referencing their tuition credit.


  8. License for Use of Submitted Essay. By submitting an application for the Scholarship, all applicant's grant an irrevocable, perpetual, royalty free, worldwide non-exclusive license to ASF, API and each of their respective affiliates, partners and promotion and advertising agencies ("Authorized Parties"), to reproduce, distribute, display, incorporate, broadcast, publish, exploit, adapt, modify and create derivative works of the entries in connection with the Scholarship and promotion of the Scholarship, in any media now or hereafter known, including, but not limited to: any product or service, whether electronically or in print, including, but not limited to, any online highlighting applications or recipients of the Scholarship, marketing and advertising materials, social media channels, publications, catalogues, brochures, books, magazines, photo exhibits, correspondence, motion picture films, videotapes, commercials, informational, or educational materials. Applicants consent to the Authorized Parties doing or omitting to do any act that would otherwise infringe the entrant's "moral rights" in their applications. Display or publication of any application on an Authorized Party's website does not indicate the applicant will be selected as a recipient. Authorized Parties will not be required to pay any additional consideration or seek any additional approval in connection with such use. Additionally, by applying each applicant grants to Authorized Parties the unrestricted right to use all statements made in connection with the Scholarship, and pictures or likenesses of Scholarship applicants, or choose not to do so, at their sole discretion. Authorized Parties will not be required to pay any additional consideration or seek any additional approval in connection with such use.


  9. Taxes. All federal, state, local or other tax obligations related to or associated with the acceptance and/or use of Scholarship is the sole responsibility of recipient, or his/her parent / legal guardian if he/she is a minor, if applicable. The Scholarship recipient shall consult with his/her tax advisor as to whether any federal, state, local or other tax obligations associated with the acceptance and use of the Scholarship and if the recipient's reportable Scholarship amounts should be included in the recipient's taxable income.


  10. Conditions. By participating, applicant's and Scholarship recipients agree to release and hold harmless ASF, Ambassadors Programs, Inc., d/b/a People to People Ambassador Programs, People to People International, and their respective affiliates, partners and promotion and advertising agencies and each of their respective parent companies, subsidiaries, affiliates, partners, representatives, agents, successors, assigns, employees, officers and directors (collectively, the "Released Entities"), from any and all liability, for loss, harm, damage, injury, cost or expense whatsoever including without limitation, property damage, personal injury or damage that may occur, directly or indirectly, whether caused by negligence or not, and/or death which may occur in connection with, preparation for, travel to, or participation in the Scholarship, or possession, acceptance and/or use or misuse of the Scholarship or participation in any scholarship-related activity and for any claims based on publicity rights, defamation or invasion of privacy and merchandise delivery. Scholarship recipient agree to indemnify Released Entities from any and all liability resulting or arising from the Scholarship and to hereby acknowledge that Released Entities have neither made nor are in any manner responsible or liable for any warranty, representation, or guarantee, express or implied, in fact or in law, relative to the Scholarship. ASF is not responsible if Scholarship awards cannot take place or if the Scholarship cannot be awarded due to travel cancellations, delays or interruptions due to acts of God, acts of war, natural disasters, weather or acts of terrorism. Applicant who do not comply with these Terms, or attempt to interfere with this the Scholarship in any way shall be disqualified.


  11. Additional Terms. In case of dispute as to the identity of any online applicant, the application will be declared made by the authorized account holder of the email address submitted at time of application. "Authorized Account Holder" is defined as the natural person who is assigned an email address by an Internet access provider, online service provider, or other organization (e.g., business, educational, institution, etc.) responsible for assigning email addresses or the domain associated with the submitted email address. Any potential Scholarship recipient may be requested to provide ASF with proof that such recipient is the authorized account holder of the email address associated with the chosen application. Any other attempted form of application is prohibited; no automatic, programmed; robotic or similar means of applying are permitted. The Released Entities are not responsible for technical, hardware, software, telephone or other communications malfunctions, errors or failures of any kind, lost or unavailable network connections, web site, Internet, or ISP availability, unauthorized human intervention, traffic congestion, incomplete or inaccurate capture of application information (regardless of cause) or failed, incomplete, garbled, jumbled or delayed computer transmissions which may limit one's ability to apply for the Scholarship, including any injury or damage to participant's or any other person's computer relating to or resulting from participating in this Scholarship or downloading any materials in this Scholarship. ASF reserves the right, in its sole discretion, to cancel, terminate, modify, extend or suspend this Scholarship application process should (in its sole discretion) virus, bugs, non-authorized human intervention, fraud or other causes beyond its control corrupt or affect the administration, security, fairness or proper conduct of the Scholarship application process. In such case, ASF may select the Scholarship recipient(s) from all eligible applications received prior to and/or after (if appropriate) the action taken by ASF. ASF reserves the right, at its sole discretion, to disqualify any individual it finds, in its sole discretion, to be tampering with the application process or the operation of the Scholarship program or Site. ASF may prohibit an applicant from participating in the Scholarship application process or receiving a Scholarship if, in its sole discretion, it determines that said applicant is attempting to undermine the legitimate operation of the Scholarship application process by cheating, hacking, deception, or other unfair playing practices (including the use of automated quick entry programs) or intending to annoy, abuse, threaten or harass any other entrants or ASF representatives.


    CAUTION: ANY ATTEMPT BY AN APPLICANT TO DELIBERATELY DAMAGE ANY WEB SITE OR UNDERMINE THE LEGITIMATE OPERATION OF THE SCHOLARSHIP APPLICATION PROCESS MAY BE A VIOLATION OF CRIMINAL AND CIVIL LAWS AND SHOULD SUCH AN ATTEMPT BE MADE, THE ASF RESERVES THE RIGHT TO SEEK DAMAGES FROM ANY SUCH PERSON TO THE FULLEST EXTENT PERMITTED BY LAW.


  12. Limitation of Liability; Disclaimer of Warranties. IN NO EVENT WILL THE RELEASED ENTITIES BE RESPONSIBLE OR LIABLE FOR ANY DAMAGES OR LOSSES OF ANY KIND, INCLUDING DIRECT, INDIRECT, INCIDENTAL, CONSEQUENTIAL OR PUNITIVE DAMAGES ARISING OUT OF YOUR ACCESS TO AND USE OF THE SERVICE AND/OR THE SCHOLARSHIP, DOWNLOADING FROM AND/OR PRINTING MATERIAL DOWNLOADED FROM ANY WEBSITES ASSOCIATED WITH THE SCHOLARSHIP. IN NO EVENT SHALL THE RELEASED ENTITIES' TOTAL LIABILITY TO YOU FOR ALL DAMAGES, LOSSES, OR CAUSES OF ACTION EXCEED $100. WITHOUT LIMITING THE FOREGOING, THIS SCHOLARSHIP OFFERING AND ALL SCHOLARSHIP AWARDS ARE PROVIDED "AS IS" WITHOUT WARRANTY OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO, THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE OR NON-INFRINGEMENT. SOME JURISDICTIONS MAY NOT ALLOW THE LIMITATIONS OR EXCLUSION OF LIABILITY FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES OR EXCLUSION OF IMPLIED WARRANTIES SO SOME OF THE ABOVE LIMITATIONS OR EXCLUSIONS MAY NOT APPLY TO YOU. CHECK YOUR LOCAL LAWS FOR ANY RESTRICTIONS OR LIMITATIONS REGARDING THESE LIMITATIONS OR EXCLUSIONS.


  13. Disputes; Governing Law. The parties waive all rights to trial in any action or proceeding instituted in connection with these Terms, including, without limitation, the Scholarship. Any controversy or claim arising out of or relating to these Terms or the Scholarship shall be settled by binding arbitration in accordance with the commercial arbitration rules of the American Arbitration Association. Any such controversy or claim shall be arbitrated on an individual basis, and shall not be consolidated in any arbitration with any claim or controversy of any other party. The arbitration shall be conducted in the State of Washington, City of Spokane. THESE TERMS AND THE INTERPRETATION OF ITS TERMS SHALL BE GOVERNED BY AND CONSTRUED IN ACCORDANCE WITH THE LAWS OF THE STATE OF NEW YORK WITHOUT REGARD TO ITS CONFLICTS OF LAWS RULES. For any matters which are not subject to arbitration as set forth in these Terms and/or in connection with the entering of any judgment on an arbitration award in connection with these Terms and/or the Scholarship, the parties irrevocably submit and consent to the exclusive jurisdiction and venue of the state and federal courts located in or closest to the County of Spokane in the State of Washington. The parties agree not to raise the defense of forum non conveniens.


  14. Use of Data. ASF will be collecting personal data about applicants online, in accordance with its privacy policy. By participating in the application process, entrants hereby agree to ASF's collection and usage of their personal information and acknowledge that they have read and accepted ASF's privacy policy.   15. Ambassadors Scholarship Foundation is a 501(c)3 not for profit public charity granted exempt status on October 30, 2008. Contributions to the Ambassadors Scholarship Foundation are deductible under section 170 of the Internal Revenue Service Code. EIN# 26-2872630.
